Qwikbuild Terms of Service

These Terms of Service (“Terms”) form a legal agreement between you and Snowmountain AI Pvt. Ltd. (“Qwikbuild,” “we,” “our,” or “us”), a company registered in Bangalore, India. Your use of Qwikbuild’s WhatsApp-based platform and related services (the “Services”) is subject to these Terms. By accessing or using Qwikbuild, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must not use Qwikbuild.


1. Eligibility and Accounts

1.1 Minimum Age
You must be at least 13 years old to use Qwikbuild. If you are under 18, you may only use the Services with the consent of your parent or legal guardian, who accepts responsibility for your activity.


1.2 Accounts and Security

  • You may need an account to use certain features.

  • You are responsible for safeguarding your login credentials and WhatsApp account.

  • Any activity under your account is your responsibility.

  • Notify us immediately at support@qwikbuild.com of unauthorized use.


1.3 WhatsApp Disclaimer
Qwikbuild operates via WhatsApp, but is not affiliated with WhatsApp Inc. Your use of WhatsApp remains subject to WhatsApp’s own terms and policies.


2. License to Use the Services

2.1 Grant of License
We grant you a limited, non-exclusive, non-transferable license to access and use Qwikbuild for creating and deploying applications and websites.


2.2 Restrictions
You must not:

  • Sell, rent, sublicense, or distribute Qwikbuild.

  • Attempt to disrupt, overload, or reverse engineer the system.

  • Use Qwikbuild for unlawful or fraudulent purposes.

  • Misuse WhatsApp APIs or violate WhatsApp’s terms.


2.3 Reservation of Rights
All rights not expressly granted to you remain with Snowmountain AI Pvt. Ltd.


3. Content and Intellectual Property

3.1 User Content

  • You retain ownership of apps, websites, and content you create with Qwikbuild.

  • You are responsible for ensuring your Content does not violate third-party rights or laws.


3.2 Qwikbuild IP
We own:

  • The Qwikbuild brand, logos, software, platform, and underlying AI models.

  • All associated designs, algorithms, and infrastructure.


3.3 License to Qwikbuild
You grant us a limited license to process, store, and handle your Content as needed to operate the Services. We may use anonymized usage data (not tied to your identity) to improve our AI models and platform.


4. Subscriptions, Payments, and Refunds

4.1 Plans and Pricing

  • Qwikbuild offers free and paid plans.

  • Features and usage limits vary by plan. Details are available on our website.


4.2 Billing

  • Subscriptions renew automatically unless canceled before the renewal date.

  • Payments are processed through secure third-party gateways.

  • You authorize us to charge your chosen payment method.


4.3 Refunds

  • No refunds are provided at this time.

  • If a refund policy is introduced in the future, it will be clearly displayed at the time of payment.


4.4 Cancellation

  • You may cancel anytime through your account.

  • Access remains valid until the end of the paid period.

  • No partial refunds for unused time.


5. Acceptable Use

You may not use Qwikbuild to:

  • Break any law or regulation.

  • Upload, generate, or share harmful, abusive, defamatory, obscene, or illegal content.

  • Spread malware, phishing links, or malicious code.

  • Infringe third-party intellectual property.

  • Circumvent usage limits, quotas, or security features.

We may suspend or terminate accounts that violate these rules.


6. Data, Privacy, and Security

6.1 Data Hosting
Data is hosted securely on Amazon Web Services (AWS) servers.

6.2 Personal Data
Our handling of personal data is governed by our Privacy Policy. By using Qwikbuild, you consent to such processing.

6.3 Data Use for AI Improvement
We may analyze anonymized usage data (e.g., feature usage, input/output patterns) to improve system performance. We will not use identifiable customer content for external training without explicit consent.


6.4 Enterprise Users

  • Enterprise clients may opt out of data collection.

  • We offer custom data agreements, enhanced security measures, and data residency options.

  • No data is shared with third parties without explicit consent.


7. Enterprise Plan Terms

Enterprise clients receive:

  • Dedicated support and service-level commitments.

  • Strict data isolation and non-use of content for AI training.

  • Optional data residency in India or other regions.

  • Custom contract terms upon request.


8. Termination

  • You may terminate by deleting your account and canceling subscriptions.

  • We may suspend or terminate your account for violations of these Terms, non-payment, or legal requirements.

  • Upon termination, your access ends and your Content may be deleted within 90 days (except where retention is required by law).


9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties
Qwikbuild is provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free operation, or fitness for your specific purpose.


9.2 AI Limitations

  • Apps or websites generated may contain errors, bugs, or vulnerabilities.

  • You are solely responsible for testing and reviewing outputs before use.


9.3 Liability Cap
Our total liability to you will not exceed the fees you paid us in the 12 months before the claim.


10. Indemnification

You agree to indemnify and hold harmless Snowmountain AI Pvt. Ltd., its directors, employees, and affiliates from claims, losses, or damages arising out of:

  • Your use of Qwikbuild,

  • Your Content,

  • Violations of these Terms or third-party rights.


11. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of India.

  • Any disputes will be resolved exclusively in the courts of Bangalore, Karnataka.


12. Miscellaneous

  • Entire Agreement: These Terms plus our Privacy Policy form the complete agreement.

  • Severability: If one part is invalid, the rest still applies.

  • Assignment: You may not transfer your rights under these Terms without our consent. We may assign freely.

  • Force Majeure: We are not responsible for events outside our reasonable control (natural disasters, government actions, internet failures, etc.).

  • Changes: We may update these Terms at any time. Continued use after changes means you accept them.
